In view of the preliminary objection raised by the learned counsel for the Respondent No. 2, learned counsel for the Applicant seeks leave to withdraw this Application with liberty to file an appropriate Application i. e. Cri. Revision Application in the Sessions Court.

Accordingly, the Application is disposed of as withdrawn with liberty as prayed. If a Revision Application is filed by the Applicant within two weeks from today alongwith an Application for condonation of delay, learned counsel for the Respondent No. 2 on

APL 421-17.doc instructions of the Respondent No. 2 states that he will not oppose the delay condonation Application. If the Revision Application is filed within the stipulated period, the learned Judge shall decide the Application and the Revision as expeditiously as possible and in any event within two months from the filing of the Revision Application.
