By the present Writ Petition, the Petitioners are challenging the legality and validity of the order dated 30th January 2023 passed by the Hon'ble Minister (Revenue), Revenue, Animal Husbandry and Dairy Development, Mantralaya, Mumbai. By the said impugned order operation and implementation of order dated 20th April 2021 passed by the Collector, Mumbai Suburban is stayed.

It is the contention of Mr. Jahagirdar, learned Senior Counsel for the Petitioners that the Hon'ble Minister has granted the interim relief without deciding the delay 1/3

condonation application.

Learned AGP has taken written instructions and according to the written instructions dated 6th September 2023 it has been stated that the hearing will be held before the Hon'ble Minister (Revenue), Mantralaya, Mumbai on 25th September 2023 and thereafter, the final order will be passed within two weeks.

In view of above instructions, Mr. Y. S. Jahagirdar, learned Senior Counsel states that the Petitioners are not pressing for the relief sought in the present Writ Petition. 5.

Accordingly, both the parties are directed to remain present before the Hon'ble Minister (Revenue) on 25th September 2023. The Hon'ble Minister (Revenue) is requested to decide the delay condonation application within two weeks from 25th September 2023 and if the delay is condoned, then within four weeks thereafter to decide the Revision Application.

Accordingly, the Writ Petition is disposed of with no order as to costs.

It is clarified that this Court has not examined the merits 2/3

of the case and all the contentions of both the parties on merits are expressly kept open.
