Heard learned Counsel for the Applicants (Original Appellants). This application is for bringing on record legal heirs of deceased Respondent No.2. There is a delay of 323 days in taking out the Civil Application. The delay is explained by the Applicants in para 5 of the Civil Application. The Appellants were informed by the Respondents' Advocate about the death of the Respondent only on 10 November 2011, after which, the Applicants took steps and filed the present Civil Application. The delay is adequately explained. The delay is condoned and the Civil Application is allowed in terms of prayer clauses (b) and (c). Amendment to be carried out within two weeks from today.
