The dispute in the above Petition is as regards the membership to be granted to the Respondent No.1. The orders passed by the Authorities below in favour of the Respondent No.1 granting deemed membership to the said Respondent are taken exception to by way of the above Petition.

The Learned Counsel for the parties i.e. Mr. R. S. Ghadge for the Petitioner and Mr. V. B. Dhingreja for the Respondent No.1 jointly state that the parties have amicably resolved the dispute. Towards the said end, the Secretary of the society Mr. Amin Suleman Khatri who is personally present in Court states that the Respondent No.1 would be granted BGP.

In turn, the Learned Counsel for the Respondent No.1 states that the requisite documents i.e. Deed of Dissolution of the partnership firm dated 11.02.2000 and the original Share Certificate are being handed over to the Learned Counsel for the Petitioner as also two cheques, one cheque being Rs.3,09,223/- and the other for Rs.45,376/- towards the outstanding maintenance charges. The Learned Counsel further states that in so far as the cheque of Rs.45,376/- is concerned, the said cheque would be replaced by a cheque signed by the Respondent No.1 as desired by the Petitioner society. He further states that the Respondent No.1 will see to it that the cheques are honoured. In the light of the above, the Petition to stand disposed of. [R.M. SAVANT, J] BGP.
