Heard the learned counsel for the applicant and the learned APP for the Respondent - State through video conferencing. 2.

This is an application under section 438 of Cr.P.C. It is alleged that the applicant has committed offences under section 379 r/ w 34 of Indian Penal Code and under sections 4(1), 4(1)(c) and 21 of the Mines and Minerals (Development and Regulation) Act, 1957 and under section 9 and 15 of the Environment (Protection) Act, 1986. pmw

3- aba-1051.21.doc After arguing for sometime, the learned counsel for the applicant seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice.

It is submitted by the learned counsel on instructions that the applicant would surrender before the learned Magistrate at Khadki on or before 27th April 2021. The learned Magistrate shall consider the application on the same day as far as possible. The applicant is protected till 5.00 pm of 27th April 2021. The applicant shall also appear before Crime Branch, Unit - 3 on 21st, 23rd and 26th of April 2021. The learned Magistrate shall not be influenced by the withdrawal of the present application.

Application is dismissed as withdrawn and disposed of on above terms.
