Heard. This Application is made by the Applicant / Appellant No.2 for deleting the name of Appellant No.1 Smt. Lilavati Sudamaji Bodake who died on 17/06/2013.

The learned counsel for the Applicant submits that the legal heirs of deceased Appellant No.1 are already on record.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Civil Application is allowed in terms of prayer clauses (a) and (b) which read thus:

(a) The name of Applicant No.1 be deleted from the cause title.

(b) The delay of 1 year 205 days for filing the Civil Application be condoned.

b) Civil application stands disposed off accordingly.
