1) The applicant is granted interim relief by an order dated 4.7.2016.The submissions advanced by the learned counsel for the applicant are in detailed recorded in the said order. I have read the statement of the victim i.e. first information report dated 10.2.2016 and the supplementary statement dated 27.2.2016. After perusing the said two statements I find that there is substance in the submissions made by the learned counsel for the applicant which are recorded in the order dated 4.7.2016.The Investigating Officer is not present despite the intimation from the office of the Public Prosecutor, High Court, Mumbai.

2) Be that as it may, after taking into consideration the

2 /2ABA-647-16-15 first information report dated 10.2.2016 and the supplementary statement dated 27.2.2016 I am of the view that custodial interrogation of the applicant is not necessary. The interim relief granted by an order dated 4.7.2016 is hereby confirmed.
