Heard the learned counsel for the applicant and the learned APP for the respondent-State.

By this application, the applicant seeks his enlargement on temporary bail on the ground that the applicant is getting married on 27th April, 2015.

The applicant was arrested in connection with C.R. No.154 of 2009, registered with the DCB-CID, Mumbai for the alleged offences punishable under various sections of the IPC, the Arms Act and the MCOC Act.

The learned counsel for the applicant submits that the marriage of the applicant is scheduled on 27th April, 2015 and seeks temporary bail for a period of ten days. The said prayer is opposed by the learned APP. She submits that till date 62 witnesses have been examined in the said case and the arguments are almost over and now the matter is kept in the Trial Court on 30th April, 2015. She, however, does not have any objection for release of the applicant on temporary bail for a period of two days, i.e. on 27th and 28th of April, 2015, for a few hours on each day. Accordingly, the

following order is passed:

ORDER

(i) The applicant shall be taken to his residence at Vikhroli, Mumbai on 27th April, 2015, under police escort, and thereafter, to the Marriage Hall at Mulund. On 27th the applicant shall be taken by the escort party from the Jail at 9:00 a.m. and will be brought back to the Jail on the very day at 10:00 p.m.. (ii) On 28th April, 2015 the applicant will be taken by the escort party from the Jail to his residence at 8:00 a.m. and on the very day will be brought back to the Jail at 6:00 p.m.. (iii) The applicant shall deposit the escort charges with the Jail authorities in advance. (iv) The escort party to accompany the applicant in plain clothes.

(v) The applicant to co-operate with the escort party.

(vi) The Jail authorities, Mumbai Central Prison shall do the needful on their part to ensure compliance of the order.

The application is accordingly disposed of.

All concerned, including the Jail authorities, to act on the authenticated copy of this order.
