Heard learned Counsel for the parties.

By this application, the Applicant seeks modification of the condition set out in clause (a) of para 4, imposed by this Court (Coram:A.S.Gadkari, J.) vide order dated 25th April, 2017, passed in Criminal Bail Application No.2508 of 2016.

The condition of which modification is sought, reads thus:- "4.

....

(a) The applicants be released on bail in CR No.153/2015 dated 14.4.2015 registered with Mira road Police Station, Mumbai on their furnishing PR bond of Rs.50,000/- each with one or two solvent local sureties in the like amount."

Learned Counsel for the applicant states that the applicant is unable to get local solvent sureties and therefore prays that the applicant be permitted to furnish solvent sureties from the State of Maharashtra instead of local sureties.

It appears that the applicant is in custody, despite the order dated 25th April, 2017, passed by this Court, in Criminal Bail Application No.2508 of 2016, as he is unable to furnish one or two solvent local sureties in the like amount.

Accordingly, for the reasons mentioned in the application, the application is allowed and the condition set out in clause (a) of para 4,

3/3 imposed by this Court (Coram:A.S.Gadkari, J.) vide order dated 25th April, 2017, passed in Criminal Bail Application No.2508 of 2016, stands modified, inasmuch as, 'the applicant shall now be released on bail in CR No.153/2015 dated 14.4.2015 registered with Mira road Police Station, Mumbai on his furnishing PR bond of Rs.50,000/- with one or more solvent sureties in the like amount'. It is not necessary for the applicant to furnish local solvent sureties and the applicant is permitted to give solvent sureties from anywhere, within Maharashtra. Rest of the conditions imposed vide order dated 25th April, 2017, to remain as it is. 7.

The Application is allowed and disposed of in above terms. 8.
