The petitioner has challenged the order dated 26th March, 2019 passed by the learned Additional Sessions Judge and Special Judge under MCOC of cancelling the order of bail granted in favour of the petitioner/accused.

It is informed by the learned APP that after the grant of bail to the accused, the investigating agency has applied MCOC Act after seeking necessary prior approval and hence, as the accused is now prosecuted for the offence punishable under MCOC Act, he is required to be taken in custody.

In view of invocation of MCOC Act, the order of cancellation of bail is correct. The police to take further steps. However, the accused may apply for bail before the Special Court. 5.

Writ Petition is disposed of.
