P.C. :- By a reasoned order dated 5th April 2018, the Applicant was granted interim relief.

Heard learned Counsel for the Applicant and the learned APP. Perused the record.

It is the case of the prosecution that a truck bearing No. MH-06-K-8559 was intercepted by the officers of Mundhwa Police Station, Pune on the suspicion that the said truck was carrying food grains which was meant for public distribution

13. ABA 652.18.doc system and for contravention of the Provisions of Essential Commodities Act. The said truck was accosted and it was found that co-accused Nitin Sonawane was driving the same. In the enquiry, Nitin Sonawane informed the Police that he was to take the said truck to the shop of the Applicant, who runs a grocery shop. It is the case of the Applicant that he is a grocery shop owner and Nitin Sonawane used to visit his shop. 4.

It is the matter of record that the said truck alongwith 390 gunny bags containing 50 kg. Wheat in each have already been seized by the Police. It further appears that the investigation of the present crime is on the version of completion and therefore the custodial interrogation of the Applicant for further investigation of the present crime is not necessary. 5.

In view of the above, the interim relief granted by order dated 5th April 2018 is hereby confirmed. However, the condition to attend the Investigating Officer is waived. 6.

Application is allowed in the aforesaid terms. (A.S. Gadkari, J.)
