1] In the second round of proceedings, the Applicant seek his release on bail on the ground of his long incarceration of 4 years and 10 months in connection with CR No.No.I-82/2018, in which the Applicant came to be arrested on 30.01.2019. He is accused of committing an offence punishable under Section 307, 326, 392, 397, 201, 34 of the IPC.

2] I need not touch the merits of the matter since in the earlier round, the Application was withdrawn with liberty reserved to approach, if charge is not framed within a period of 3 months. 1/2

(30)BA-1314-2023.doc 3] Today the learned APP makes a statement that the charge is not framed, and definitely the trial would consume a considerable time. The long incarceration of the Applicant is sufficient reason to release him on bail. Hence, the following order :

(a) Bail Application is allowed.

(b) Applicant - Ravi @ Ravindra Dattu Pandit shall be released on bail in connection with C.R.No.I-82/2018 registered with Kasara Police Station on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.

(c) The applicant shall report to the concerned Police Station on first Monday of trimester between 10.00 a.m. to 12.00 noon.

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.

(e) The Applicant shall regularly attend trial, on every date, unless exempted.

(f) Upon release, the Applicant shall furnish his contact number and permanent residential addresses to the Investigating Officer and shall keep him updated in case of change in the same.
