The learned counsel appearing for the Applicants has placed on record a copy of report submitted by the Investigating Officer to the Learned Magistrate claiming 'C' Summary. He states that request for grant of 'C' Summary is not yet accepted by the learned Judge. On the prayer made by the learned counsel appearing for the Applicants, we permit him to withdraw the application in view of the aforesaid report. In the event 'C' Summary is not accepted, it will be open for the Applicants to file appropriate proceedings for the reliefs which are claimed in this application as well as for challenging the order passed by the learned Magistrate. All contentions on merits are kept open.
