This civil application prays for liberty to withdraw the First Appeal and directions to the Trial Court to return original documents submitted before it at the hearing to the Applicant/Appellant. Learned Counsel for the State as well as Municipal Corporation of Greater Mumbai (MCGM), have no objection to the application being allowed. They, however, submit that they are not parties to any settlement as suggested in paragraph-2 of this civil application. It appears that the matter is settled privately between the Applicant/Appellant and some other party and the State and MCGM are not parties to such settlement.
