Heard Mr. Vaishnav, learned counsel for the applicant and Mr. Tiwari, learned counsel for respondent no. 3.

By this Application, the applicants have prayed for condonation of delay of 50 days in preferring the present appeal. Respondent nos. 1 and 2 appears to be the contesting respondents. They are served, however, there is no reply affidavit placed on record opposing the present application. Respondent no. 3 is represented by Mr. Tiwari, who states that respondent no. 3 is a formal party. 3.

Having perused the averments as made in the application, in my opinion, sufficient cause is made out to condone the delay in preferring the appeal. Civil Application is accordingly allowed in terms of prayer clause (a). 4.

Disposed of in the above terms.
