1] Considering the judgement of this Court in Tulsiwadi Cooperative Society Vs. State of Maharashtra and in particular Clause (d) of para 118, we are permitting the petitioner to move the High Power Committee. The respondent No.3 a Registered society has already filed such an application challenging the same order, which is pending. Respondent No.4 is also in the process of filing an application before High Powered Committee being aggrieved by the same order.
YBG wp4389-16 2] Liberty is granted to parties to file application within one week from today, if not already filed. The concerned authority / High Power Committee to deal with the application in accordance with law. However, at this stage, we are inclined to observe that the impugned order dated 23rd March 2016 and the notice dated 1st April 2016 shall not be acted upon for a period of four weeks. Liberty is granted to parties to move High Powered Committee for appropriate orders. Petition is disposed of accordingly.
