The grievance of the Petitioner is that Tribe claim is pending for consideration with the Scrutiny Committee. During pendency of the Tribe claim the Petitioner is placed on supernumerary post. It is submitted that since September 2021 the caste claim is pending with Respondent-Scrutiny Committee for verification and validation.

We have considered the submissions.

The Petitioner shall appear before the Respondent-Scrutiny Committee on 5 July 2023. The Scrutiny Committee shall

k 2/2 13 wp 5213.03 as.odt endeavour to decide validation proceedings within six months from the appearance of the Petitioner. The impugned order placing the Petitioner on supernumerary post is set aside. The employer may take further course of action depending upon the judgment that would be delivered by the Scrutiny Committee in the validation proceedings.

The Writ Petition is disposed of. No costs.
