After this petition was heard for some time, Mr. Warunjikar, learned counsel for the petitioner, seeks leave to withdraw the petition with liberty to approach the National Highways Authority of India, having its office at S.No.134/1, BAIF Bhawan Campus, Dr. Manibhai Desai Nagar, Warje, Pune­411058, with a comprehensive application, seeking deletion of the acquisition of the lands of the petitioner, which were acquired for the purpose of National Highway.

Accordingly, the petitioner is permitted to withdraw this petition with liberty as prayed for. The petitioner shall submit a ABS

WP 5873-2014 proposal / application to the National Highways Authority within a period of 4 weeks from today. If such a proposal is submitted, the National Highways Authority shall consider the same within a period of 8 weeks from the date of submission of the proposal. All contentions of the parties on merits are kept open. 3.

The writ petition is disposed of in the above terms. No costs.
