P.C.:- 1) At the outset, learned APP on instructions from Mr. Rokade, API, Chitalsar Police Station, Thane City, submitted that, the investigation of the present crime has already been completed. However, in view of the Order dated 2nd November, 2020 passed by this Court charge-sheet could not be filed. She further submitted that, if this Court grants leave, the concerned Investigating Officer will submit charge-sheet before the concerned Court within a period of two weeks from today. The said statement is accepted.

2) In view of the above, learned Advocate for the Applicant seeks leave to withdraw the present Application with liberty to file an Application 1/2

ssm 2 14-apl441.20.doc for discharge as contemplated under the provisions of Cr.P.C., before the trial Court.

Leave and liberty granted.

3) Application is disposed off, with aforesaid liberty. 4) It is made clear that, this Court has not adjudicated the issues involved in the present Application and it has been disposed off on the ground that, the investigation of the present crime has been completed and the leave sought by the learned counsel for the Applicant.
