1] Applicant is seeking regular bail in C.R. No. I-420/2019 registered with Shil Daighar Police Station for offence punishable under Sections 302, 201, 120(B) 506(2) r/w 34 of the Indian Penal Code and Section 4, 25 of the Indian Arms Act, Section 37(1)/135 of the Maharashtra Police Act.

2] Statement of eye witnesses namely Radhesham Paswan, Faisal Khan does not implicate the applicant with any active role in the crime. No specific overt act in the commission of serious crime is 1/3

alleged. Other similarly placed accused namely Shubham @ Dadya Baburao Dhamale is already ordered to be released on bail by Additional Sessions Judge, Thane, vide order dated 24/02/2021. 3] In the wake of above, particularly, not attributing any specific overt act to the applicant, release of similarly placed accused by the Additional Sessions Judge vide above referred order, case for grant of bail is made out.

(i) Applicant be released on bail in C.R. No. I-420/2019 registered with Shil Daighar Police Station for offence punishable under Sections 302, 201, 120(B) 506(2) r/w 34 of the Indian Penal Code and Section 4, 25 of the Indian Arms Act, Section 37(1)/135 of the Maharashtra Police Act upon furnishing P.R. bond in the sum of Rs. 50,000/- with one or two solvent sureties in the like amount. (ii) Applicant shall neither influence the prosecution witnesses in any manner nor tamper with the evidence. (iii) Applicant shall not commit any other or further offence.

(iv) Applicant shall visit the concerned police station twice in a week i.e. on every Monday and Wednesday during 11.00 a.m. to 1.00 p.m., till further order, and as and when the investigating officer directs him so, in writing.

(v) Applicant shall remain present on each and every date before the court for facing trial.

(vi) Applicant shall give documentary proof of his identification and permanent residence at the time of his furnishing surety.

(vi) Applicant shall not leave India without prior permission of the concerned Court.

(vii) In default of any of the above conditions, his bail bonds automatically shall stand forfeited to the Government without notice to him.

Application stands disposed of.
