Heard learned Counsel for the applicant.

This application is preferred by the legal heirs of sole petitioner Smt. Fatima Abubakar Dhalait, who died on 06.12.2015.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Delay in preferring the Civil Application is condoned.

b) Abatement is set aside.

c) Applicant is permitted to bring the legal heirs of deceased sole petitioner on record in Writ Sneha Chavan 1/2

d) Amendment to be carried out within two weeks from today.

e) Amended copy of Writ Petition to be served on Respondent's Advocate, thereafter immediately.

f) If amendment is not carried out within stipulated time as stated hereinabove, Civil Application shall stands dismissed without referring back to the court.

g) Civil application stands disposed off accordingly.
