Mr.Shelke, learned counsel for the Petitioner submits that during the pendency of this petition, Regular Civil Suit No.138/2008 has been decided and the same has been challenged by filing an appeal. Hence, the prayer in the petition has become infructuous. Petition stands disposed of with no order as to costs.
