Heard the parties. This Application is filed for restoration of the Appeal that was dismissed for non removal of office objections within time. The learned Registrar Judicial-II of this Court had passed conditional order on 4th December 2018. Since the objections were not removed within time the registration came to be refused. The learned Advocate for the Applicant submits that, though the Order was passed the objections could not be removed immediately as one of the near relative of the applicant died on 4th December 2018. Thereafter on 24th December 2018, there was another death in the family of the near relative of the Applicant. The Applicant Shubham Talle 1/2

2 30-CAF-174-2022.doc herself was also suffering from health issues being a Diabeties patient. 2.

The learned Advocate for the Respondent vehemently opposes the Application failed that the Appellant is not diligent in prosecuting the appeal and time was given by the Registrar before passing the Order of dismissal and prays for rejection of the Application. 3.

Considering that now the Applicant is ready to remove the office objections and considering that there is sufficient reasons for delay this courts allow the application by condoning the delay. 4.

The Applicant however to remove the office objections within 4 weeks from today. The office to allow the Applicant to remove office objections, if remove within 4 weeks from today and to restore the Appeal. 5.

Civil Application stands disposed of.
