This is an application for suspension of sentence and releasing the applicants-accused on bail during the pendency of the appeal filed by them. Applicants-accused came to be convicted of the offence punishable under Section 306 read with Section 34 of the IPC by the learned trial Court and they both are sentenced to suffer rigorous imprisonment for a period of one year apart from payment of fine of Rs.1,000/- and in default to suffer simple imprisonment for 15 days.

911-APPA-583-2017.doc Heard both sides and perused the impugned judgment and order of conviction so also the material placed on record. It is seen that short sentence of one year is imposed on both applicants-accused and that has already been suspended by the learned trial Court in order to enable applicants-accused to prefer an appeal before this Court. It is seen that both applicants-accused were on bail during the pendency of the trial and they have not misused their liberty.
In this view of the matter, the following order: (1) The substantive sentence of imprisonment imposed on applicants-accused is suspended and they are directed to be released on bail on executing PR Bond in the sum of Rs.15,000/- each and on furnishing surety in the like amount.
