The learned counsel for the applicant states that the trial in the present matter has been concluded. Vide order dated 10 th March, 2010 this petition was adjourned sine die with liberty to move the Court after the Supreme Court had decided the issue pending before it and arising in the above petition. Today in view of the statement of the learned counsel for the petitioner that the trial is been concluded nothing survives in this petition. Accordingly, I pass the following order:- (i) Petition is allowed to be withdrawn.

(ii) No orders as to costs.
