There were two claims arising from the same accident. One was preferred by Ashwini Bhagwan Kadam & others; the other by Anil Jagannath Kamble and another. Against the Award in favour of Ashwini Kadam, the insurer-Appellant filed First Appeal No. 2429 of 2011. That First Appeal was dismissed on 18th January 2012 (per AV Nirgude J).

The present First Appeal is from the same order but in respect of other claim by Anil Jagannath Kamble. For the reasons 11th July 2017

5-FST11211-10.DOC set out in the order dated 18th January 2012, this First Appeal must also fail.

The First Appeal is dismissed accordingly. No costs. 4.

The Civil Application does not survive and is disposed of as infructuous.
