This Petition was to be on board on 22nd August, 2017. By order dated 3rd August, 2017, this Petition was adjourned to 22nd August, 2017 and the ad-interim relief, directing the Trial Court not to proceed with the matter, was continued till 22nd August, 2017. However, Petition did not come up on that date. Therefore, the prayer to continue the adinterim relief granted on 3rd August, 2017 till the next CMIS date. The Petition itself challenges the order dated 15th March, 2017 passed by the Principal District Judge, Pune, rejecting the Petitioner's application for transfer of Marriage Petition No.39/2015 filed by the Respondent-husband from Civil Judge, Senior Division, Baramati to Family Court, Pune.

wp-5013-2017 Mr.Kulkarni, learned Counsel appearing for the Respondent, on instructions, state that his client - Mr. Harshal Joshi who is present in Court, states that he is agreeable to Marriage Petition being transferred from Civil Judge, Senior Division, Baramati to Family Court at Pune. In view of the aforesaid concession made by the Respondent who is present in the Court, the impugned order dated 15th March, 2017 is set aside and the Marriage Petition No.39/2015 is transferred from the file of Civil Judge, Senior Division, Baramati to the Family Court at Pune. Parties are directed to appear-in-person or through their Advocates before the Family Court at Pune on 15th September, 2017 so as to enable the allotment of the Petition before the appropriate Court. The Family Court at Pune is directed to dispose of this Marriage Petition No.39/2015 as expeditiously as possible and preferably on or before 31st December, 2018.
