The learned Counsel for the petitioner seeks leave to withdraw the writ petition and to make an application to the learned Principal District Judge that Regular Civil Suit Nos. 321 of 2004 and 311 of 2004 both pending before the Civil Judge Junior Division, Ichalkaranji, be tried together.

The Writ Petition is disposed of with liberty as prayed. The application so made will be decided on its own merits after hearing both the sides.
