Heard the learned counsel appearing for the petitioners and the learned counsel for the respondents. The learned counsel appearing for the respondents, on instruction, states that the prayer made by the petitioners for regularization in respect of the land bearing Survey No.113 of village- Kaunche, Patelpada and land bearing Survey No.46 of the same village has been processed and prayer made in respect of Survey No.113 was decided to be accepted. However, the prayer made as regards Survey No.46 has been rejected. He states that the aforesaid decision has been taken on 27th April 2018.

In view of the aforesaid statement, it is not necessary to keep the petition pending and we dispose of the same by passing the following order:

SKN 2/2 4458.17-wp.doc (i) We accept the aforesaid statement made by the learned counsel for the respondents on instructions;

(ii) We direct the respondents to communicate the aforesaid decisions to the petitioners within a period of four weeks from today;

(iii) The petitioners can always challenge the decision in accordance with law, if they are aggrieved by the same. All contentions on merits are kept open;

(iv) Writ petition is disposed of accordingly.
