The learned Counsel for Petitioners, upon instructions, volunteers to deposit costs of Rs. 25,000/- by 25th April 2018 before the learned Sessions Judge, Mumbai so as to demonstrate his regret, having not conducted the Appeal against conviction for last one year before the Sessions Court.

The learned Counsel for Petitioners would invite attention of this Court on Para No. 18 of the Writ Petition and assures that no further

2/2 Yadav 909.wp.1622.18 adjournment in the matter will be sought for whatsoever reasons including that of engagement of new Counsel and the Appeal will be worked out before the Sessions Court as directed by the said Court. 3.

In view thereof, by way of last indulgence, the learned Additional Sessions Judge (21st Court), City Sessions Court, Mumbai is directed to grant hearing to the Petitioners in Criminal Appeal No. 0100136/2017 (Rajesh Kumar J. Singh V/s State of Maharashtra), provided he conduct himself in compliance with the aforesaid conditions/undertaking.

If the Applicant - Accused fails to comply and conduct in the light of above observations, learned Appellate Court will be at liberty to pass appropriate orders against the Petitioner. 5.
