There is delay of 1 year and 168 days in filing the First Appeal. Delay is sufficiently explained in paragraphs 5 to 7 of the Civil Application No.1512 of 2017. The civil application is made absolute in terms of prayer clause (a) on the condition that the applicants pay a sum of Rs.10,000/- to the Kirtikar Law Library within two weeks from today and shall produce a receipt showing payment of such costs to the Sheristedar of this Court within one week from the date of payment. It is made clear that if the cost is not paid within the time prescribed, the order passed by this Court to stand vacated without further reference to the Court.
