Mr.Kapse, the learned counsel for the applicant makes a statement that as of yet the applicant is not in receipt of IOD/Sanctioned Plan from the developer. Accordingly, he seeks leave to withdraw the present Civil Application with liberty to file a fresh Civil Application upon receipt of IOD/Sanctioned plans. 2.

Leave is granted and the Civil Application is dismissed as withdrawn with liberty as prayed for.
