The order impugned in the petition under Section 7A and 7B of the Employees Provident Funds and Miscellaneous Provisions Act, 1952 ("the Act" for short) is capable of being challenged before the Appellate Authority under Section 7(i) to the Act. 2.

Therefore, keeping all questions raised in the petition open to be agitated before the Appellate Authority, the writ petition is disposed of by granting liberty to the petitioner to challenge the validity of the impugned order before the Appellate Authority. 3.

The period spend in prosecuting the present petition shall be excluded while considering limitation for filing of appeal. (AMIT BORKAR, J.)
