This Application is moved for anticipatory bail, as the applicant/accused apprehends arrest in C.R. No. I-438 of 2014 registered at Bhadrakali Police Station for the offences punishable under sections 420, 418, 406, 120B of Indian Penal Code at the instance of Milind Mahadu Nikam on 15th November, 2014.

It is the case of the prosecution that in the year 2012, he along with his relatives invested money with the applicant/accused and many other persons also invested money on the promise given by the applicant that he would pay higher rate of interest and the amount would also be saved. However, neither the interest as promised nor the amount which was invested were returned to them. There are nearly 16 persons apart from the complainant and thereafter the complainant approached the police 1 / 2

After hearing both the parties and on perusal of the order of this Court dated 3rd March, 2015, I express that I am not inclined to grant prearrest bail to the applicant/accused. The learned counsel for the applicant/accused informs the Court that as the Court is not willing to grant pre-arrest bail, then the Application may be dismissed or he may be allowed to withdraw.

The statement of the learned counsel for the applicant/accused is accept on the condition that no other Anticipatory Bail Application would be filed in any Court in this case, as the Court has expressed to reject the Application. Hence, the learned counsel for the applicant is allowed to withdraw this Application.
