1] There is no dispute that the issues raised in the present petition are more or less covered by the issues raised in Writ Petition No. 4647 of 2014 (The State of Maharashtra vs. Vivek Vishwanath Rane). Therefore on basis of the reasoning in the judgment and order made in Writ Petition No. 4647 of 2014, even this petition is liable to be dismissed.
2] In fact, in the present matter, it appears that there
skc JUDG-WP-5747-2013 was no issue of any departmental enquiry pending against the respondent no. 1. The MAT, in its impugned judgment and order dated 4th June 2012 has taken cognizance of case of Dr. Smt. Bhide who was granted benefits similar to those claimed by the respondent no. 1 herein. The MAT has also relied upon the decision of this Court in Writ Petition No. 1084 of 2003 dated 11th July 2005.
3] According to us, there is no jurisdictional error or any other error so as to warrant interference with the impugned judgment and order. Accordingly, this petition is dismissed. There shall be no order as to costs.
4] In view of dismissal of the petition, civil application does not survive and stands dismissed.
