The learned counsel for the Petitioner Ms. Pratibha Shelake h/f Mr. P J Thorat and the learned counsel for the Respondent No.2 Mrs. Aarti Bhide tender Consent Terms bearing today's dated i.e. 09/10/2015 evidencing settlement arrived at between the Petitioner and the Respondent No.2 who are the sister and brother. The said Consent Terms have been signed by the Petitioner and the Respondent No.2 as also the learned counsel for the Petitioner Shri P J Thorat and the learned counsel for the Respondent No.2 Mrs. Aarti Bhide. The said Consent Terms evidences the settlement arrived at between the parties. In so far as other Respondents are concerned, they are formal parties. The Petitioner and the Respondent No.2 are personally present in Court. The learned counsel for the Petitioner and the Respondent No.2 pray that the above Petition be disposed of in terms of the said Consent Terms. The
modalities for payment of Rs.45,00,000/- [Rupees Forty Five Lakhs only] which is agreed to be paid by the Respondent No.2 to the Petitioner have been mentioned in the said Consent Terms. The Respondent No.2 has forwarded a cheque of Rs.10,00,000/- [Rupees Ten lakhs only] to the Petitioner in furtherance thereof. The Respondent No.2 who is present in Court states that the said cheque would be honoured. Both the Petitioner and Respondent No.2 when put in the box and questioned make a statement that they have signed the said Consent Terms of their own free will and volition and that they are are acceptable to them. The said Consent Terms are taken on record and marked as "X" for identification. The above Writ Petition is disposed of in terms of the said Consent Terms.
