Heard learned counsel for the parties.

By this application, the Applicant seeks pre-arrest bail in connection with C.R. No.33 of 2017 registered with the Sangli City Police Station, Sangli, for the alleged offences punishable under Sections 354, 354(a)(2) of the Indian Penal Code.

Learned Counsel for the Applicant states that since 2012, there is some dispute between the applicant and the Complainant. He relied on certain documents in support of the said submission. He submitted that the Complainant had

promised to withdraw the 138 case as against the Applicant, after she receives a sum of Rs.1,55,000/-. He submitted that as the said amount was not paid by the Applicant to the Complainant, the aforesaid complaint was lodged i.e. C.R.No.33 of 2017. According to the Complainant, on 2nd February, 2017, when she was proceeding home from the market along with her daughter, the Applicant came from behind, pushed her, looked at her and smiled. She has alleged that the Applicant told her that he wanted to meet her alone. She has further alleged that by the said act of the Applicant her modesty was outraged. 4.

Learned APP states that the Applicant has attended the concerned police station as directed by this Court. 5.

Considering the peculiar facts of this case and the nature of allegations, custodial interrogation of the Applicant is not necessary. Accordingly, the Application is allowed and the Applicant is granted pre-arrest bail on the following terms & conditions:- O R D E R (i) In the event of arrest, the Applicant be enlarged on bail, on executing PR Bond in the sum of Rs.15,000/- with one or

two sureties in the like amount;

(ii) The Applicant shall attend the concerned Police Station on every Monday between 10:00 a.m. to 12:00 noon till the filing of the charge-sheet;

(iii) The Applicant shall not tamper with the or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
