Learned Counsel for the petitioner argued the matter for some time. He invited my attention to the impugned order. He assailed the impugned order on the grounds which are raised in the Petition. During the course of hearing, it is brought to my notice that the hearing of the Suit has already commenced and the plaintiff has already lead his evidence.

In this view of the matter, as the trial of the Suit has already commenced, interest of justice will be served if the trial Court is directed to decide the Suit itself expeditiously. Learned Counsel for the respondent has no objection to this course of action. The present Petition is therefore disposed of with direction to the trial Court to decide the Suit as expeditiously as possible and preferably with a period of 6 months from today.
