This is an application for suspension of sentence and releasing the applicants-accused on bail during the pendency of the appeal filed by them.
Both applicants-accused are convicted of the offence punishable under Section 324 of IPC by the learned trial Court and they are sentenced to suffer rigorous imprisonment for one year apart from payment of fine of Rs.5,000/- each in default of payment of fine simple imprisonment for a period of three months.
Heard the learned advocate appearing for the applicant-accused as well as the learned APP. Perused the Shivgan 1/2
913-APPA-587--2017.doc impugned judgment and order of conviction. It is seen that applicants-accused were on bail during the pendency of the appeal and they had not misused their liberty. Short sentence of one year is imposed on both of them. Hearing of the appeal will take its own time. The substantive sentence of imprisonment imposed on applicants-accused has already been suspended by the learned trial Court. In this view of the matter, the following order: (1) The substantive sentence of imprisonment imposed on both applicants-accused is suspended and they are directed to be released on bail on executing PR Bond of Rs.15,000/- each and on furnishing surety in the like amount.
(2) The application stands disposed of accordingly.
