Mr. Nangre, learned Counsel for the applicants on the basis of written instructions from the applicants seeks leave to withdraw this C.R.A. Accordingly, leave is granted and CRA is dismissed as withdrawn.
2] Notwithstanding the aforesaid, Mr.Nangre on behalf of applicant seeks three months time to vacate the suit premises and hand over possession thereof to respondents.
3] In the peculiar circumstances of the present case and
YBG 41-cra-688-14 subject to the applicant's filing an undertaking within two weeks from today, the eviction decree shall not be executed for a period of three months from today. Copy of fresh undertaking to be furnished to the learned Counsel appearing for the respondent before the same is actually filed in the Registry. If no such undertaking is filed within two weeks, then, there shall be no bar for execution of the decree. C.R.A. is dismissed in the aforesaid terms.
