Rule. Rule made returnable forthwith with the consent of the parties.

Learned Counsel for the respondent No. 1 has filed affidavit in reply and it is submitted that the present petition has become infructuous in view of the fact that procedure of enquiry which was challenged, has attained finality. The enquiry is concluded and the petitioner has been terminated from service with effect from 12/7/2017. The said order of termination is under challenge before the Labour Court. In view of this, the Labour Court shall decide the legality and validity of the termination order in accordance with the law without being influenced by the order of the Member, Industrial Court, Pune Talwalkar

36.wp5885.18.doc dated 2/8/2017 passed in Complaint(ULP) No. 194 of 2017. It is made clear that present petition has not been heard on merits of the matter. With these observations/directions, the petition stands disposed of. The Rule is discharged.
