Heard learned counsel for the Applicants.

Learned counsel for the Applicants submits that this Court (Coram : Justice K.K. Tated J.) by order dated 16th April, 2019 had directed the Applicant to file the paper-book within one year from the date of the order. The Applicants could not comply the said order. Hence, Appeal is dismissed.

Learned counsel further submits that Respondentsclaimants have withdrawn 50% amount out of deposited amount, if appeal is restored no prejudice would cause to other side. 4.

Considering the submission of learned counsel for the Applicants and the reasons mentioned the the application, the Application is allowed in terms of prayer clauses (a), (b) and (c). (SHIVKUMAR DIGE, J.)
