DATED :
AUGUST 22, 2016.
P.C. :
Learned counsel appearing for the petitioners on instructions seeks leave to withdraw the petition. Learned counsel submits that affidavit in reply is filed by respondent
rpa 2/2 wp-1487-16.doc no.16. Learned counsel has referred the contention raised in paragraph no.1 in the said affidavit which reads as under: "1) I say that I have read over the contents of present Criminal Writ Petition along with annexure thereto. I say that I am well conversant with the facts of present case and I have gone through records & proceedings of present case which are made available to me and therefore, I am filing the present Affidavit in Reply, inter alia opposing the admission of present Criminal Writ Petition and interim reliefs prayed therein. I reserve my right to file an Additional Affidavit in Reply, if necessary at the time of hearing of present Criminal Writ Petition."
Learned senior counsel Shri Thorat submits that petitioner no.1 has absolutely no locus to file the petition. Couple of petitions were earlier filed in this Court raising issues of sanction and legality of the sanction of the redevelopment. Now the project is ready.
As the petitioners seeking leave to withdraw the petition, we grant leave to withdraw the petition. Petition is dismissed as withdrawn.
