The Applicant has filed this Anticipatory Bail Application in respect of C.R. No. 180 of 2018, registered at Mahim Police Station, Mumbai.

Learned APP pointed out that the Applicant had earlier approached this Court vide ABA No. 401 of 2021. A co-ordinate Bench of this Court (Coram: Smt. Anuja Prabhudessai, J.) vide a reasoned order dated 25/04/2023, had rejected the said application. Learned APP pointed out that the Applicant is not available and therefore he could not be arrested. He is still y.s.patil
19-ABA-1062-2024.odt absconding. In this background, the Applicant has approached this Court for the same relief of anticipatory bail in the same subject matter.

Learned counsel for the Applicant submitted that after the order dated 25/04/2023, the additional charge-sheet against other co-accused was filed and therefore after that the Applicant preferred another application for anticipatory bail, before the Sessions Court. After rejection of that application, he has preferred this Application.

The Applicant's conduct speaks for itself. He has been absconding since rejection of his application on 25/04/2023. The offence is registered in the year 2018. His earlier Anticipatory Bail Application No. 401 of 2021 was rejected by a detailed reasoned order. In this view of the matter, it would not be appropriate for this Court to entertain this Application, in the background of the submissions made by the learned APP. Therefore, the application is dismissed.
