This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending her arrest in Crime No. 60 of 2023 registered at Pimpri Police Station, Pune for the offences punishable under Sections 332, 353 r/w.34 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the prosecution, on the date of incident which took place on 12 January 2023, the present applicant and other co-accused Kanchan P Dhuri 1 / 2

32-ABA-1023-2023.odt had raised the dispute with the anti-encroachment squad personnel and obstructed them from removing encroachments. It is further alleged that the applicant and other co-accused assaulted home guards Shri Eknath Patil and Shri Janardan Khedkar by first blows. 5.

The Sessions Court has granted anticipatory bail to one of the co-accused. There are no other criminal antecedents. Apart from it, there appears to be no need of custodial interrogation. Considering the overall facts and circumstances, I am inclined to release the applicant on anticipatory bail. Hence, the following order is passed: (i) Application is allowed.

(ii) In the event of arrest of the applicant - Sweety Rajkumar Singh in Crime No. 60 of 2023 registered at Pimpri Police Station, Pune for the offences punishable under Sections 332, 353 r/w.34 of Indian Penal Code, she shall be released on furnishing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount subject to payment of Rs.25,000/- by the applicant to the Police Welfare Fund. (iii) The applicant shall attend the concerned police station as and when called by the Investigating Officer and shall co-operate in the investigation.
