Learned counsel for the respondent Mr. Gite submits that the respondent is ready and willing to accept a sum of Rs.2,60,000/- deposited by the petitioner in the Labour Court, Nashik pursuant to the order dated 28 th April, 2016. It is further submitted that he may be allowed to withdraw the said amount with interest, if any, accrued on the said amount. 2.

The respondent is present in person. Mr. Gite tenders the respondent's affidavit undertaking that the respondent will not claim reinstatement with the petitioner and that this amount of Rs.2,60,000/- is accepted in full and final settlement. Undertaking taken on record and marked "X" for identification. In view of the above I pass the following order : 1/2

4-wp-13594-2017.odt (i) Respondent Shri Govind Shankar Ahire is at liberty to withdraw the sum of Rs.2,60,000/- which was deposited in the First Labour Court, Nashik to the credit of Application no. IDA 1 of 2016 and interest, if any accrued thereon. (ii) The undertaking of the respondent that he will not claim reinstatement and that he has no other claim against the petitioner is accepted. Undertaking taken on record and marked 'X' for identification.

(iii) In view of the above petition is disposed.
