By this Civil Application, the Applicant is seeking condonation of 328 days delay in filing the First Appeal challenging the judgment and award dated 19.03.2012 passed by the Bombay City Civil Court at Mumbai in L.C.Suit No.193/2011.

Though the Respondent is duly served, none appeared for him when the matter was called out.

10.4382.13-caf.odt Application, I am satisfied that the Applicant has made out a case for allowing the Civil Application.

Hence, following order is passed.

a.

Delay in filing the First Appeal is condoned.

b.

The Applicant is directed to remove all office objections on or before 31.08.2019 failing which the First Appeal shall stand dismissed without further reference to the court.

c.

If all Office objections are removed within stipulated time as stated hereinabove, Office is directed to place the First Appeal for admission on board on 05.09.2019.

d.

Civil Application stands disposed of accordingly.
