It is an application under Section 407 of the Criminal Procedure Code, whereby the applicant is seeking transfer of proceedings under Section 125 of the Criminal Procedure Code in Criminal M.A. No.2129/2020 form the Court of Judicial Magistrate First Class-III, Pune to the

Family Court where Petition No.1129/2018 is pending, being fled by the applicant-husband.

Indisputably, respondent-wife had also fled D.V. proceedings against the petitioner being Criminal M.A. No.1829/2019 in the Court of Judicial Magistrate First Class, Pune. This Court, vide order dated 10th December, 2019 transferred D.V. proceedings to the Family Court, Pune where applicant has fled a petition for divorce. 4.
