Heard Mr. Apte, learned Senior Counsel for the petitioner and Ms. Bane, learned A.G.P for respondent No.1. 3.

Mr. Apte states that petitioner No.1 is present in the

510-W.P. No. 4491-2017 Court. Upon taking instructions from him, he seeks permission to withdraw the petition. He submitted that this petition challenges Letters dated 31st March, 2017, 10th April, 2017. Respondent No.4 has instituted civil suit and the same is pending. In case, trial Court holds that suit instituted by respondent No.4 is not maintainable or passes any adverse order in the pending suit against the petitioner, liberty may be reserved to the petitioner to file fresh petition.

In view thereof, the petition is allowed to be withdrawn with a liberty to file fresh petition in case occasion arises. [R.G. KETKAR, J.]
