This Application is moved for relaxation of condition nos. 3 and 4 in the operative portion of the order dated 29th October, 2015 passed by the Additional Sessions Judge, Thane. By condition no. 3, the applicants are directed to attend the police station on every 4th Monday of the month till further orders. By condition no. 4, the applicants were directed not to leave India without prior permission of the Court and shall report compliance of the order on fix remand date.

The learned senior counsel appearing for the applicant/accused submitted that since October, 2015, the applicants/accused are attending the police station on every 4th Monday of the month. He further submitted that all these applicants/accused are businessmen and they have to frequently travel abroad for business purpose and it is cumbersome for the 1 / 2

912.Appln.237_2016.doc applicants/accused to approach the Court every time for relaxation of condition no. 4.

Learned APP is present and informs that the Investigating officer is absent.

On query, the learned senior counsel informs that there are no antecedents to the credit of the applicants/accused. 5.

In view of the submissions of learned senior counsel for the applicants/accused, condition no. 3 is hereby relaxed. The applicants/accused need not attend the police station on every 4th Monday of the month except they shall attend the police station as and when called by the Investigating officer till filing of the charge sheet. Condition no. 4 is hereby relaxed and instead following direction is substituted: "The applicants/accused shall submit their itinerary to the Investigating officer whenever they will travel abroad and shall also provide the address of their stay abroad."
